Welcome to MailMind. These Terms of Service govern your use of our AI-powered email management platform. Please read them carefully before using our service.
1. Acceptance of Terms
By creating an account or using MailMind, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.
These terms apply to all users of MailMind, including free and paid plan subscribers.
2. Service Description
MailMind is an AI-powered email management platform that connects to your email accounts (Gmail and Outlook) to provide:
- Automated email triage and priority scoring
- AI-generated email summaries and reply drafts
- Automation rules for email handling
- Mail merge and template dispatch capabilities
- Task management extracted from emails
- AI chat assistant for inbox queries
The service requires you to authenticate with your email provider via OAuth 2.0. MailMind operates on top of your existing email accounts and does not replace your email provider.
3. User Accounts
You are responsible for maintaining the confidentiality of your account and any activities that occur under it. You agree to:
- Provide accurate account information
- Maintain the security of your authentication credentials
- Notify us immediately of any unauthorized access
- Not share your account with others or create multiple accounts
We reserve the right to suspend or terminate accounts that violate these terms.
4. Acceptable Use
You agree not to use MailMind to:
- Send spam, unsolicited bulk email, or phishing messages
- Violate any applicable laws or regulations, including CAN-SPAM and GDPR
- Infringe upon the intellectual property rights of others
- Transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service to harass, abuse, or harm others
- Exceed the usage limits of your subscription plan
- Reverse engineer or attempt to extract source code from our software
5. Subscription and Billing
MailMind offers Free, Pro, and Business subscription plans. By subscribing to a paid plan:
- You authorize us to charge your payment method on a recurring basis (monthly or annual)
- Prices may change with 30 days' advance notice
- You may cancel your subscription at any time; access continues until the end of the billing period
- Refunds are available within 14 days of initial purchase
- Downgrades take effect at the start of the next billing cycle
Payment processing is handled by Paddle, our merchant of record. Paddle's terms and privacy policy also apply to payment transactions.
6. Intellectual Property
MailMind and its original content, features, and functionality are owned by MailMind and protected by international copyright, trademark, and other intellectual property laws.
Your content (emails, templates, automation rules, data tables) remains yours. By using MailMind, you grant us a limited license to process your content solely for the purpose of providing the service. We do not claim ownership over your content and will not use it for any purpose beyond delivering the service to you.
7. Limitation of Liability
To the maximum extent permitted by law, MailMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the service
- Any unauthorized access to or alteration of your transmissions or data
- Any third-party conduct on the service
- Any interruption or cessation of service
- Errors in AI-generated content, including email summaries, triage scores, or reply drafts
Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.
8. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may temporarily suspend access for maintenance, updates, or reasons beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
MailMind depends on third-party services (Google, Microsoft, AWS) and their availability may affect our service.
9. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms of Service. Upon termination:
- Your right to use the service ceases immediately
- We will delete your data within 30 days unless required by law to retain it
- Any outstanding fees remain due
You may terminate your account at any time through your account settings.
10. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect. Your continued use of MailMind after changes are posted constitutes acceptance of the updated terms.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these terms or your use of MailMind shall be resolved through binding arbitration, except where prohibited by law.
